Affiliate Program Terms of Service

By joining the MyThemeForest Affiliate Program (“Program”), you agree to adhere to the following terms and conditions (“Terms of Service”).

Changes to Terms

MyThemeForest reserves the right to modify these Terms of Service at any time without prior notice. Any new features or tools introduced to the Program will be subject to these Terms. Continued participation in the Program following changes constitutes acceptance of the updated Terms.

Account Terms

• You must be 18 years or older to participate.
• Only individuals, not bots or automated systems, may register.
• Provide accurate legal name, email address, and any other requested information.
• Your account is for individual use only; sharing logins is prohibited.
• You are responsible for maintaining account security. MyThemeForest is not liable for any loss due to security breaches.
• You are accountable for all activity under your account.
• Only one account per person or entity is allowed.
• The Program must not be used for illegal or unauthorized purposes.
• You cannot use the Program to earn commissions on your own MyThemeForest product accounts.

Links and Graphics

• Upon registration, you will receive a unique Affiliate Code. Use this code in the provided links, banners, or graphics on your site, in emails, or other communications.
• Follow the provided guidelines for link formats to ensure accurate tracking and referral fee accrual. Failure to use Special Links correctly may affect your referral fees.
• Affiliate links should direct users to the specific product page being promoted.

Referral Fees and Payments

• To earn referral fees, the customer must click through a Special Link and complete a purchase during the session.
• Commissions are only paid on sales tracked by our system. Claims based on untracked sales or incorrect Affiliate Code usage will not be honored.
• We reserve the right to disqualify commissions from fraudulent or aggressive marketing methods.
• Payments are made monthly, provided you have earned at least $20. If not, payments will be delayed until the threshold is met.

Identifying Yourself as an Affiliate

• Do not issue press releases regarding your participation in the Program. Misrepresenting your relationship with MyThemeForest is prohibited.
• Purchases made through your affiliate links for personal use may result in withheld referral fees or termination from the Program.

Customer Definition

• Customers acquired through the Program are subject to MyThemeForest’s rules and policies. Prices and availability may vary, so avoid displaying product prices on your site.

Your Responsibilities

• You are responsible for your site’s operation and content, including technical aspects, accuracy of information, and compliance with third-party agreements.
• Ensure that your site and materials do not infringe on any rights or violate any laws.
• Clearly disclose how you collect, use, and store visitor data, including any third-party data collection.

Compliance with Laws

• You agree to comply with all applicable laws and regulations, including anti-spam laws like the CAN-SPAM Act of 2003.

Term and Termination

• This Agreement begins upon acceptance and may be terminated by either party at any time with written notice.
• Upon termination, remove all MyThemeForest links and materials. We reserve the right to end the Program and settle any outstanding earnings above $20.

Termination Rights

• MyThemeForest may suspend or terminate your account at its discretion for any reason, including fraudulent or aggressive marketing practices. Termination will result in the loss of all potential commissions.

Relationship of Parties

• You and MyThemeForest are independent contractors. Nothing in this Agreement creates a partnership or employment relationship.

Limitations of Liability

• MyThemeForest is not liable for indirect, special, or consequential damages. Our total liability is limited to the referral fees paid under this Agreement.

Disclaimers

• We do not warrant the Program or products sold through it. We do not guarantee uninterrupted or error-free operation of MyThemeForest.

Independent Investigation

• You acknowledge that you have read and understood this Agreement and that you are not relying on any representations other than those in this document.

Arbitration

• Disputes related to this Agreement will be resolved through confidential arbitration, except for cases involving intellectual property rights, where we may seek relief in court. Arbitration will be governed by the American Arbitration Association rules.

Miscellaneous

• This Agreement is governed by U.S. law. It cannot be assigned without our written consent. It constitutes the entire agreement between you and MyThemeForest and supersedes any prior agreements.
